This new law impacts new vehicle dealers only, beginning 7/1/xxxx:
Sellers must process eligible retail sales transaction via an Electronic Vehicle Registration (EVR) system. There are a few transactions that still cannot be cleared using an EVR system. The EVR fee cannot exceed the amount actually charged by the first-line service provider. This fee is in addition to dealer documentation prep fees, must be itemized on the sales contract and cannot be represented as a governmental fee. This requirement does not apply to sellers of RV, Off-Road or Motorcycle products, and does not become an unlawful act until 10/1/xxxx
This new law impacts all retail sales effective 7/1/xxxx:
The temporary permit affixed to the vehicle by the seller has been modified. Forms, REG 51 and REG 397, VEHICLE PURCHASER?S TEMPORARY OPERATING COPY, have been modified. The permit is no longer valid for 6 months; the permit is valid for 90 days. The vehicle operator can be cited for continuing to use the vehicle with an expired temporary operating permit, or for failing to affix plates once department records show they have been issued.

The seller of any used vehicle must have possession of information from the National Motor Vehicle Title Information System (NMVTIS)

If the NMVTIS report certificate of title information indicates a title brand, the seller must post a warning notice near the buyer?s guide. The notice must contain language specified in statute, except for the title ?Warning? must be printed in 14 point bold black print, on at least a 4 x5.5 inch red background.
There are currently 5 service providers. Fees range from $2.99 to $6.99, based upon the service provided, which includes storing a report copy to print on demand, printing stickers, periodic updates if a specified period has elapsed and smart phones apps.

AB xxxx impacts motor vehicle dealer sales effective July 1, xxxx, unless otherwise indicated. The following summarizes the changes:
1. Section xxxx (c) (2) of the Vehicle Code is amended - Applicable to New and Used vehicle dealers. Shortens the timeframe from 6 months to 90 days during which a vehicle may be operated on the temporary permit provided by the dealer (report of sale form). Drivers operating a vehicle with the dealer issued temporary permit after 90 days may be cited.
2. Section xxxx.4 (a) ? (c) is added to the Vehicle Code - Applicable to New vehicle dealers only. Requires licensed new car dealers to participate in a DMV approved Electronic Registration System (EVR) for registering and titling all vehicle transactions as of July 1, xxxx. (Note: This section does not apply to Off-Road Vehicles, Recreational Vehicles or Motorcycles.)
3. Section xxxx.5 (a) ? (c) is added to the Vehicle Code - Applicable to New and Used vehicle dealers. Authorizes a dealer under a contractual agreement with DMV as a private industry partner to charge a document processing fee not to exceed $80. The fee charged by dealers not under a contractual agreement shall not to exceed $65. The Electronic Vehicle Registration (EVR) filing charge may not exceed the actual amount the dealer is charged by a first-line service provider. The EVR fee is in addition to the dealer document processing fee. No fee in this section shall be represented as a governmental fee. (Note: The dealer document preparation fee has been removed from xxxx3.1(b).
4. Section xxxx3.1 (y) of the Vehicle Code is amended. Applicable to New Motor Vehicle Sales after October 1, xxxx. It shall be unlawful for a dealer to sell or lease a new motor vehicle after this date, unless the dealer has a contractual agreement with the department to be a private industry partner pursuant to VC Section xxxx. (Note: This section does not apply to Off-Road Vehicles, Recreational Vehicles or Motorcycles.)

5. Section xxxx3.21? of the Vehicle Code is amended - Applicable to Used car dealers ? Contract Cancellation Option. These Vehicle Code sections are amended to read as follows:
xxxx3.21(2)(D) One percent of the purchase price for a vehicle with a cash price of more than thirty thousand dollars ($30,000), but less than forty thousand dollars ($40,000).
The term ?cash price? as used in this paragraph has the same meaning as described in subparagraph (A) of paragraph (1) of subdivision (a) of Section xxxx of the Civil Code. ?Cash price? excludes registration, transfer, titling, license, California tire and optional business partnership automation fees.
6. Section xxxx3.26 (a) ? (h) is added to the Vehicle Code. Applicable to New and Used car dealers. Require dealers to obtain a National Motor Vehicle Title Information System (NMVTIS) report for all used vehicles for sale as of July 1, xxxx; and affix a warning sticker on any vehicle, if the certificate of title contains a brand.
Sticker specifications and the required language are defined in subsection (b) (1). The retailer must provide a copy of the NMVTIS vehicle history report upon request. (Note: This section does not apply to Off-Road Vehicles, Recreational Vehicles or Motorcycles.)
National Motor Vehicle Title Information System (NMVTIS)
The National Motor Vehicle Title Information System is designed to protect consumers from fraud and unsafe vehicles and to keep stolen vehicles from being resold. NMVTIS is also a tool that assists states and law enforcement in deterring and preventing title fraud and other crimes. Consumers can use NMVTIS to access important vehicle history information.

Implementation of AB xxxx, Suspension of Tax Debtors ?
AB xxxx requires all agencies that license businesses or individuals to suspend the license of an individual or business whose name appears on the top 500 list of delinquent tax cases as prepared by the Franchise Tax Board (FTB) and the Board of Equalization (BOE). This includes the suspension of driver licenses. Summary of changes:
? DMV will receive quarterly lists from BOE and two lists per year from FTB. The first lists will not be sent to DMV until after July 1, xxxx, with the first lists to be compiled in October.
? Upon receipt of a list, DMV must try to match the information with a driver license holder, Occupational Licensing holder, or Motor Carrier Permit holder. The lists will include both individuals and businesses.
? The licensee will have 90 days to resolve the issue with FTB/BOE prior to the suspension taking place.
? Once suspended, FTB/BOE must provide a clearance notice to authorized DMV to allow the license to be reinstated. An administrative fee will be required before the license can be reinstated. (The fee to reinstate a license will be established in regulations.)

Vehicle Code Section xxxx1 Automatic Cancellation
xxxx1. The special plates and licenses provided for in this article shall be automatically canceled upon the happening of any of the following:
(a) The abandonment of the established place of business of the dealer or the change thereof without notice to the department as provided in Section xxxx2.
(b) The failure of the licensee to maintain an adequate bond or to procure and file another bond as provided in Section xxxx0 prior to the effective date of the termination by the surety of any existing bond.
(c) The voluntary or involuntary surrender for any cause by the licensee of the special plates and license, except that the surrender of the special plates and license, the cessation of business by the licensee, or the suspension or revocation of the corporate status of the licensee, does not preclude the filing of an accusation for revocation or suspension of the surrendered license as provided in Section xxxx5, does not affect the department's decision to suspend or revoke the license. The department's determination to suspend or revoke the license may be considered in issuing or refusing to issue any subsequent license authorized by this division to that licensee or to a business representative of that prior licensee.
(d) Notification to the department that the person designated as licensee has changed, except that the special plates issued to the original licensee may be transferred and the newly designated licensee as transferee shall succeed to the privileges evidenced by the plates until their expiration.
(e) The suspension or revocation of the corporate status of the licensee.
(f) The suspension or revocation of the seller's permit of the licensee by the State Board of Equalization.
